The following Terms and Conditions describe how Blank Mode Games (“Company”, “we”, “us” “our”) collects, uses and discloses information about users of the Company's websites (blankmode.games, jazzvswaffles.com, neveros.app, whatmustburn.com), mobile applications (Other Calc), online services, tools and features (collectively, the “Services”). For the purposes of this page, “you” and “your” means you as the user of the Services.

By downloading, accessing, or using our games, websites and/or services, these terms will automatically apply to you – therefore you should make sure that you read them carefully before using the game. You are not allowed to copy or modify the game, any part of the game, or our trademarks in any way. You are not allowed to attempt to extract the source code of the game, and you also shouldn’t try to translate the game into other languages, or make derivative versions. The game itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Blank Mode Games.

The Blank Mode Games services, including but not limited to the Jazz Versus Waffles game, stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your browser/device and access to the game secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone/computer/tablet/device vulnerable to malware/viruses/malicious programs, compromise your device’s security features and it could mean that the Jazz Versus Waffles game won’t work properly or at all.

You should be aware that there are certain things that Blank Mode Games will not take responsibility for. Certain functions of the game will require the game to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Blank Mode Games cannot take responsibility for the game not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the game outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the game, or other third party charges. In using the game, you’re accepting responsibility for any such charges, including roaming data charges if you use the game outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the game, please be aware that we assume that you have received permission from the bill payer for using the game.

Along the same lines, Blank Mode Games cannot always take responsibility for the way you use the game i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Blank Mode Games cannot accept responsibility.

With respect to Blank Mode Games’s responsibility for your use of the Service, when you’re using the Service, it’s important to bear in mind that although we attempt to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Blank Mode Games accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the game.

We make regular updates and optimizations to our games and services. The requirements for devices, browsers and network connections (and for any additional systems we decide to extend the availability of the game to) may change. Blank Mode Games does not promise that it will always update the game so that it is relevant to you and/or works with a version that you have installed on your device. We may also wish to stop providing the game, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the game. Any payments made will be honored through the end of the payment term, with the exception of in the event that the user (you) has broken our Terms and Conditions.

Subscriptions, Payments & Accounts

If you buy or subscribe to any of our paid Services, you may be subject to pay applicable fees and taxes in U.S. Dollars. Taxes may be calculated based on the billing address you supply at the time of purchase. In subscribing to our paid Services, you agree that we may store and continue billing your payment method (e.g. credit card) to avoid interruption of the Services. We reserve the right to change our subscription plans or adjust pricing for the Services in any manner and at any time at our discretion. Except as otherwise provided in these Terms, any price changes or changes to your subscription and payments will take effect following reasonable notice to you. Payment can be made by credit card or other means that we might make available. Subscriptions will not be processed until payment has been received in full.

Paid Subscriptions

If you purchase a subscription from one of our sites or services, your subscription will automatically renew at the subscription term frequency referenced on your subscription page (or if not designated, then monthly), and your payment method will automatically be charged at the start of each new subscription term for the fees and taxes applicable to that term.

Cancellation Policy

To avoid future subscription charges, you must cancel your subscription, in which case your cancellation will be effective at the end of your then-current subscription period. Following any cancellation by you, you will continue to have access to the paid Services through the end of the subscription period for which payment has already been made. You may cancel your subscription through the subscription settings on your Account page.

Refund Policy

Payments for any Services are non-refundable and there are no credits or refunds for partially used terms or periods. If you have an issue with your subscription or believe you have been charged in error, please contact info@blankmode.games.

Promotional Codes

We may offer certain promotions or promotional codes that may be redeemed for free trails, subscriptions, or other features or discounts related to our Services. Promotional Codes may not be duplicated, sold or transferred in any manner, or made available by you to the general public unless expressly permitted by Blank Mode Games. Promotions may be disabled, discontinued, or have additional conditions applied to them at any time for any reason. Promotions and promotional codes are not valid for cash and may expire prior to your use of the promotional code.
